i was asked to sale 3 guitars for a friend at a pawn shop because he did not have a ID. Now 3 months later?
guitars for sale December 28th, 2009the police have came to me and accused me of steeling 5 guitars . At the time i sold the guitars i had no idea that they were stolen. the guitars were taken from oklahoma to texas . i want to know what the law is in this case or for any advice on what to do.
Next time please make your question more understandable and use proper grammar..
If you were selling them for a friend, you should’ve asked where the guitars came from, no one just gives someone 5 guitars and asks you to pawn them off.
The only way out of this situation is to prove that someone gave those to you, and then the police will go to him/her to ask them questions, or else you go to jail for theft and robbery.

you had better be able to give up your friend [using the term loosely here] pdq to police and hope that he states that they where HIS property in the first place…………. why was there NO red flags when your friend had no ID………… did he go inside the pawn shop with you?? or did he state he had none and off you trotted……

You can be charged with receiving stolen property among other things, even if you didn’t know they were stolen. Your friend used you so if he got caught you would take the fall and not him.

Get a lawyer. Interstate transport of stolen goods is a Federal crime, and even if the Feds don’t get involved you could still find yourself extradited back to OK to face charges there.

No idea that they were stolen, huh? Interestingly enough, MOST people who sell stolen goods say exactly the same thing.
Unless your friend freely admits that he gave them to you and did not tell you they were stolen, you will be found guilty of possession of stolen goods. They may not be able to prove you stole them yourself (I hope you have an alibi), but you did have them, and that makes you liable for criminal charges.

Get a lawyer ASAP.
Your friend will need to provide irrefutable proof that he obtained the guitars legally. You do not have any obligation to contact your friend – that is why you get a lawyer involved. The lawyer does all of the dirty work and pleads your case in the court. You just have to be willing to provide every detail, and be willing to tell the 100% truth.
Good luck.
